her. looks like she's calm and ready to go. for more insider information about the big week ahead leading up to sunday's big ball game, let's check in with comcast sports net bay area ahmed fareed. this morning the 49ers voting for their mvp of the season and it's a player who has seen troubles off the field. he's actually had a lot of success on the field as well. good morning. >> reporter: jon, it's a good point. quite honestly it was an off-season to forget for aldon smith for the 49ers. incidents from january until june. he credits justin smith, a teammate of his on the defensive side of the ball, another guy that went to missouri with helping him both on and off the field. justin was the team's mvp last year and now can pass the torch to smith. 2012 bill walsh award winner as team mvp as voted on by jim harbaugh and the rest of the

making for a gorgeous sunrise after 7:00 this morning. chilly outside. 33 degrees in napa. 40 in san jose. 46 in san francisco. not much wind right now. the story of the day will be northwest winds picking up and moving into the afternoon. here come high clouds from north to south making for some filtered sunshine early in the day and then we'll see partly cloudy skies through the afternoon. hour by hour forecast lunchtime looking at high clouds mixed with sunshine and mainly clear skies. just some patches of high clouds drifting by from north to south into the afternoon. around midday we'll see numbers already in the low 60s. these numbers warming up as north winds pick up bringing in drier and warming air into the north bay valleys and then mid to upper 50s around san jose around 3:00 and 4:00 this afternoon. numbers are going to continue to warm up this week as high pressure takes hold. we'll see mid to upper 60s and even near 70 around santa cruz thursday and friday and for the weekend partly cloudy. still looking good for super bowl sunday and then probably some rain monday into tuesday of

next week. mike? >> all right. we're looking at the san mateo bridge here and nothing unusual for typical tuesday here. i'll start over on the peninsula side but we'll cover both sides of that bridge. here 101 and 280 moving smoothly. i want to call out a new incident. crash reported north 101 north of 92. a car went off the roadway at the off-ramp and went into the bushes. as a crew arrives on scene, you'll see distraction. no reports of any injuries but i'll track that as well. if they have to send more vehicles there, it will be more distraction. that's north of 92 on the peninsula. north toward 92 for 880 we have slowing approaching but really the earlier crash is the concern. typical slowing starting to build coming down south into hayward off san lorenzo. that's your commute. northbound we don't typically see this. especially not as much slowing as we do right now. earlier crash and debris and activity on the shoulder. two vehicles involved are on the shoulder itself presenting more

issues because there are flashing lights. it turned to green. perhaps it's much better suddenly over the last few. we'll continue to check that one. meanwhile, we see the build continue to slow for west 580 through livermore approaching the dublin interchange. 680 keeps speeds close to 60 through pleasanton and into the sunol grade. a live look outside. see how things are for san jose. i want to show you volume. traffic tuesday means a bigger volume of traffic building quicker. this is 101 at 680. on our maps you see slowing for interchange. otherwise the rest of the south bay looks good. we'll see 87 and 85 showing slowing over the next 20 minutes likely. quick look at the bay bridge toll plaza. we do see the cash lanes all still backed up. fastrak lanes not backing up. let me refresh the report. metering lights turned on and we'll see fastrak lanes filling in. back to you. this morning the top brass at oakland's police department

will talk about how it is dealing with a series of shootings in that city one of which was a drive-by that sent an 8-year-old girl to the hospital. "today in the bay's" christie smith joins us live in oakland with more details about what police are vowing to do following the latest shooting. good morning, christie. >> reporter: good morning to you. this little girl certainly wasn't doing anything wrong. she was standing outside when someone pulled up and opened fire. she was shot in the leg. this happened in broad daylight in front of a home. she was taken to the hospital and is expected to recover. this comes right after two oakland police officers were shot. one in the arm and one in the leg just doing their jobs. they are recovering as well. the little girl was shot around 2:30 in the afternoon on 65th avenue yesterday. police say several people were getting out of an suv when a car load of people pulled up and opened fire. bullets flew through the windows and walls of the home.

she was taken to the hospital and was the only one hit. this is renewed calls for a state of emergency in oakland for outside help to be brought in but the city denied that same request just a few weeks ago saying they already have help. the police chief showed up at the scene to try to send a strong message. >> make sure that this pattern doesn't continue. if my being out here sends a message that the department is taking it seriously, i'll be out here every time that happens. hopefully it doesn't happen more. >> reporter: now it's frustrating and sad but children caught in the cross fire or shot as bystanders is not new in oakland. in 2011, you may recall gabriel martinez was shot and killed near his family's taco truck in east oakland. that same year, a toddler was shot in exchange of gunfire near a liquor store in west oakland. also, a 3-year-old was shot after being hit by a stray bullet and killed when strolling with his family also in east oakland.

welcome back. 6:13. six months after the boy scouts reaffirmed its long standing stance on gays, the organization says it's rethinking the stance. the policy is under scrutiny after a boy scout was denied his eagle scout badge after he came out as gay to his troop leaders. the family organized a petition drive on change.org which has collected well over 460,000 signatures. the policy cost the boy scouts corporate support. just last year computer chip maker intel and u.p.s. withdrew support because of the gay ban. the new policy would let individual chapters decide whether or not to accept gay members. the policy shift will be discussed next week in irving, texas. turning to business and tech news, rare talk of layoffs in silicon valley. >> scott mcgrew, former high flyer. >> if you said a year ago vmware

would cut jobs, people would have laughed. the new hot stock. the company says it will cut 900 jobs from underperforming departments. vmware shares fell 13% on the news of the trouble. wall street really likes new yahoo! ceo marissa mayer. she met on the phone last night with reporters and analysts saying yahoo! made more money than analysts expected. it's a give me though due to low expectations. yahoo! about 4% more money this year compared to last which isn't much. google's growth was around 22%. also said revenue growth would probably slow going forward. what's far more important is mayer's leadership. she told reporters and analysts that yahoo! employees listed 485 problems for her to solve and was well on her way to solving them. speaking of cool, the fellows at

stories we're following this morning. a developing one in texas where firefighters are trying to contain a fire at an oil well after an early morning explosion in van zandt county just southeast of dallas. two people were injured and we're now hearing one is on life support. bp expected to plead guilty to manslaughter and pay a record $4 billion in penalties for that 2010 oil spill in the gulf of mexico. a federal judge expected to make a decision on that deal sometime today. former 49ers offensive lineman harris is now facing jail time after he was accused of beating up his ex-boyfriend during a fight in august. harris pleaded not guilty this week to domestic violence and assault charges. the case will continue in april. a lot of heavy hearts right now as an impromptu display of love in the south bay will go away. for months now couples have been hanging personalized padlocks on the main street bridge in los

gatos as a symbol of their love to each other. town officials are worried this one is becoming a safety hazard. "today in the bay's" bob redell is live in los gatos with what the town council is planning to do with those locks. bob, good morning. >> reporter: they plan to take them down come friday. good morning to you, jon. we're here on the main street bridge in los gatos overlooking highway 17. this started in august when this couple, tim and carolyn, decided to put one of these locks of love as they're called up here on this fence for their 30th anniversary. as you can see, other people kind of got the same idea to celebrate anniversaries, their love for each other and birthdays and that sort of thing. this fence is flimsy. caltrans became concerned. they own the bridge. with the extra weight and if there were a wind storm, the fence could come down and integrity of it would be compromised and end up falling down on cars below on highway 17. the city of los gatos which is in charge of maintenance for anything on the upper deck of the bridge has said that come

friday they'll cut these locks down and they'll actually be storing them at their corporation yard until february 15th. if you have one of these locks up here and you don't want to get it yourself, it will be available for you until february 15th. february 14th. valentine's day. museum of los gatos came forward saying we'll unveil a new exhibit. something with a bridge motif. chain link fence. won't be over a road but it will be a place for you to hang your locks of love. reporting live here in los gatos, bob redell, "today in the bay." >> all right. reminder valentine's day right around the corner. >> 6:18 right now. rob mayeda is here to tell us about what's happening outside. a good day. >> it is. kind of chilly right now. temperatures in the 30s and 40s around the bay area. later this afternoon we should see some low 60s today warming up a lot more later this week. right now some high clouds over the san francisco bay and waiting for sunrise which i think will be spectacular. high clouds ahead.

with high clouds you get sunrise and makes for some wild orange and pink and peach sunrises. we'll watch that just after 7:00 this morning. right now 46 degrees in san francisco. 40 in san jose. 38 degrees in livermore. and still the winds haven't picked up yet. by the afternoon we'll see winds 10 to 20 miles an hour. high pressure starts to build in which will set the stage for the rest of your workweek warmup. lots of 60s and if you're on the coast with offshore winds may see the numbers getting closer to 70. here you can see high pressure building in from the west. this will act like a shield taking the incoming storms and moving them to the north and removing us from the cool pattern we saw over the weekend into monday to one that will steadily warm up our temperatures starting midweek, wednesday, thursday, friday, mid 60s even around san francisco, san jose, upper 60s and 70s possible south of san jose and around santa cruz. high temperatures today upper 50s closer to san jose and probably some low 60s down around santa cruz for the

afternoon. around tri-valley we'll see numbers in the upper 50s and low 60s around pleasanton and sunol and into oakland 59 degrees. 62 in santa rosa. 60 in napa. north bay valleys seeing numbers come up as north winds start to mix down some drier air into the region. next few days just a slow steady warmup. it will be thursday and friday. you'll see the most sunshine and warmest temperatures here as we wrap up the workweek with 70s possible near the coast. and for the weekend, a few extra clouds staying dry and cooling into early next week. mike? >> all right. we'll take folks out here to the south bay north of san jose you are just fine as far as south bay slow downs. 101 and 87 starting to build. 101 past capital we see yellow kicking in. that means a slower drive. more cars hitting the road this traffic tuesday. 101 the brunt of it. 680 to 880 and sharks are playing anaheim ducks tonight. a shout-out to my cousin. the sharks are going to win.

to fremont, a slower drive from a stall south 680. still sticking out into lanes. be careful. it slows from there down toward mission boulevard. there's the funnel down through fremont. we'll look at the flow of traffic. 680 through pleasanton okay. we show good volume of traffic causing the slow drive out of livermore. we'll show more flow of traffic here. this is the change-up. northbound side cleared earlier accident just in time to show the slowdown building over the next 20 minutes. southbound side is your typical first to start and castro valley y and approach to the toll plaza. there's your tuesday build heading toward that san mateo bridge. on the peninsula side we'll look at the volume of traffic on foster city and san mateo side. steady flow west 92 on the peninsula. no issues as far as interchange. 92 at 101. earlier crash still there but off the roadway. distraction as crews do arrive chp heads there. bay bridge toll plaza, look at

today president obama lays out his plan to overhaul the nation's laws, beef up the border and keep more than 11 million people illegal immigrants in this country. "today in the bay's" tracie potts joins us live in washington d.c. let's talk about the difference between this plan and the one that congress announced just yesterday. >> reporter: the white house says for the most part it's going to be the same. big components like more border security and something senators were calling for and also a path to citizenship for people who are in this country illegally. one thing that could be different is the president is expected to talk about same-sex immigrants and the benefits and rights they would have under this new comprehensive plan. that's something that was not mentioned and pointed out by some was not mentioned at all by the lawmakers yesterday. >> interesting. do you think that's going to be one of the major hurdles to the president getting his plan passed? >> reporter: it could be because it's been a big issue here and other pieces of legislation here on capitol hill. the big challenge here is going

to be conservatives particularly on the house side who are most concerned with border security and who are probably not going to be swayed to support this plan if the president tries to push what they might consider the very aggressive same-sex initiative along with it. >> the senate plan would track people in this country for visas and require immigrants to prove they have been working but some are skeptical that will work. who are they and why do you think they are so doubtful about it? >> reporter: because sometimes it's hard to prove. a lot of times these people are working under the radar. they are being paid under the table. so while they have been working and working very hard for a long time, they don't necessarily have the documentation to prove that. should that stop their path to citizenship, that's one of the details they'll have to work out. >> frightened for so long to even come forward. thank you very much, tracie. 6:32 right now. investigators continue looking for exactly what caused and

sparked a house fire in san jose. the pair was taken to the hospital and treated for minor injuries. they were battling a fire yesterday at a home. the red cross is assisting with six adults and five children who were left homeless. chp is on the hunt for drivers who turned 880 into a side show venue this weekend. here's a look from above at the evidence left behind. tire marks after several drivers tried to do burnouts. you see them there. this was at northbound 880 near the oakland coliseum. happened saturday afternoon around 4:00. the spinning cars blocked all lanes of northbound 880 while spectators recorded chaos on their owns. chp now studying the video posted on youtube in hopes of identifying suspects and license plate. so many people stopped on the road were calling 911. >> people on the hoods of their car videotaping that and

everything. that's nuts. 6:33. rob mayeda is here to tell us good weather ahead and i like the plan for super bowl sunday. >> look at the sunrise across the bay. orange skies. mid and high level clouds going by. before 7:00 now it's going to turn all orange and pink across the sky as we get a nice start to your day. right now 46 degrees in san francisco. 40 in san jose. still some low 30s around the north bay and parts of the east bay for the morning. you'll see the high clouds going north to south. not going to drop rain but filter out sun at times for the first half of the day and then high pressure building in will lead to temperatures climbing up next couple of days. by lunchtime we should see partly cloudy skies. mixed with high clouds and sunshine during the day and temperatures here hour by hour by lunchtime not too bad. close to 60 inland and low 60s across parts of the north bay today and then the rest of the bay area going to see the warmup over the next couple afternoons. we're talking 60s for the coast through inland valleys starting tomorrow and maybe even close to

70 around santa cruz thursday and friday. partly cloudy and mild moving into the weekend. mike? >> we're looking at the volume of traffic kicking in for nimitz freeway. traffic tuesday. here past oakland coliseum northbound side picking up a lot of company but speeds close to the limit. southbound side also similar situation. however, heading down toward the san mateo bridge the 92 interchange a new crash reported. you see slowing typical any way as you head into hayward. from what i understand, chp says it's in the middle lanes but they have to get there. i'll let you know as they update the situation as well regarding that crash hopefully moved to the shoulder soon. it's in your commute as you head south of hayward into fremont and union city and even affecting you heading toward the san mateo bridge. tri-valley shows slowing west 580, south 680 through dublin, pleasanton and into sunol. typical pattern but things held up west 580 to isabelle exchange. crash out of lanes but distraction. i've seen more slowing build up as you come out of livermore and

over toward pleasanton and eastbound 580 similar area. issue now as you pass north livermore. reports someone lost their snowboard. they want chp to run a traffic break. you have to slow down through livermore. this is also the way you head toward the central valley 580 and interstate 80 with no chain control right now. that's one option at least. we're looking at north 101, north 85, north 87 with slowdowns for the south bay really kicking in with volume again. traffic tuesday sees a heavier flow of traffic and now a new crash north 680 right around capital expressway. may stick out into a lane. we haven't seen slowing over the last few but we'll track this. quick look at emeryville. i turned the camera to show you the approach to the bay bridge toll plaza. there at the bottom of your screen the approach and backup here berkeley curve slow to the scene itself. we'll end with this shot and send it back to you. it could soon get even more tough to light up in san

francisco. later today board of supervisors could approve a proposal to ban spo smoking at street fairs and festivals. another proposal would force landlords to disclose whether their building allows smoking to potential tenants. backers say most people are unaware their neighbors are even allowed to smoke. a follow-up to a story we brought you yesterday. pg&e says thousands of colorful gnomes in oakland neighborhood can stay. for now. utility company says it has spoken to the artist responsible for attaching these tiny paintings to power poles. pg&e wants to remove the gnomes so other people don't follow and do this and attach more creations to those poles. the artist agreed to help pg&e with a plan t relocate the gnomes. more than 2,000 of them he's put out there. pg&e has agreed to let them stay until they can find a suitable alternative or home.

an update to breaking news we're following in texas where firefighters are still trying to contain a massive fire after an explosion at an oil storage facility just southeast of dallas. two people are seriously injured. a 24-year-old woman reportedly on life support and a 24-year-old man has burns to his face, chest and arms. there are five large storage tanks at that facility. two of which already exploded. a wild scene from china. cameras catch a building collapsing right into a sinkhole. just a massive hole there in a southern city. yesterday afternoon in china

and this morning, all the latest on the 49ers and their quest for six super bowl titles. plenty of the niners giving us an inside look at their trip to new orleans through social media. a snapshot taken by wide receiver chad hall as the team stopped by the french quarter for some dinner. the caption says all of us tonight may be the best cornbread i ever had. vernon davis also tweeting out pictures from new orleans. he spotted a huge poster with his image on it. how cool is that? just on a walk around town. the caption on the picture showing love and tweeting from new orleans, 49ers ceo jed york. quite a view he has overlooking the mississippi river. the caption old man river is looking good this morning.

the fog in new orleans this morning making it difficult to see any river at all. we check in live with ahmed fareed. looks like the 49ers brought that san francisco fog rolling in with them. >> reporter: yeah. i can guarantee the river is back there. the bridge is back there too. it was easier to see yesterday as fog rolls in today. no secret. new orleans is a town where you can get into some trouble. the 49ers players are well aware of that. they do have a team curfew. runs all of the way to the super bowl. it is difficult for them especially when they're in that downtown hotel. they walk out three blocks to bourbon street and see stuff like this. we saw randy moss and frank gore wandering canal street right now looking for a bite to eat. immediately when they went out of the hotel, fans were around them wanting pictures and

50s as the game goes on. back to the bay area, 30s and 40s outside. not much of a north wind yet but by lunchtime we'll see high pressure build in and that will lead to temperatures climbing up 60s to maybe even near 70 in a few spots by the time we wrap up the workweek. the satellite radar view shows you high clouds from north to south. clouds making for a great sunrise this morning. high pressure builds on top of northern california wednesday, thursday, friday, mid 60s and maybe close to 70 around santa cruz and close to 70 in morgan hill thursday and friday afternoon. around the bay area, upper 50s close to 60 around santa cruz. 58 degrees in gilroy. you see pleasanton and sunol maybe some low 60s today. good bet of that come tomorrow. for the north bay, low 60s during the afternoon as north winds pick up around santa rosa and sonoma. wednesday, thursday, friday,

temperatures in the 60s. if you are going to have a party or picnic outside for super bowl sunday, looks okay. low 60s this weekend. >> bummed about the chicken wings though. north 101 we do have a slowdown. rest of the peninsula looks okay. through san mateo as we zoom in, all of the way up toward third avenue, we had earlier that crash. then just in the same area chp is right by this latest crash involving reports of a big rig and motorcycle which sounds like a tragic situation but as far as i hear, no injuries. sounds like they bumped as they were coming off the roadway slowing down so that might be a better situation as we track that. a big concern as we track that motorcycle-involved accident on the peninsula side. south 880 continues to jam as this three-car crash i told you about south 880 approaching 92. chp taking a while to get there. very quick work of this area.

something is going on. we see the backup slamming down south from hayward approaching the san mateo bridge. castro valley y will ripple back over there. traffic tuesday volume heavy throughout the bay area. we'll look at issues. here in the tri-valley slow through the dublin interchange and south through sunol for 680 but complicated by issues in livermore west at isabelle a crash in the center divide. a distraction adding more slowing and eastbound we saw slowing for the last five minutes as there's a traffic break. someone dropped the snowboard. things have smoothed out. n more debris reported. we'll track that. the south bay continues to build. 101, 87 slowing down and 85 with speeds in the 50s and 40s coming up toward saratoga kicking in for that drive in toward cupertino. we'll look at san jose. volume and live look shows what we are talking about. berkeley down the east shore freeway building and slowing

now. speeds into the 50s as you come underneath university avenue and of course the bay bridge toll plaza. we end with this shot. nothing unusual. that's the backup. back to you. oakland police this morning searching for a person who shot a first grader. an 8 year old outside of her home. police say a car pulled up outside of the home near 65th and international boulevard and then opened fire. bullets flying through the suv and the home there. the 8-year-old girl was shot right in the leg. terrifying scene there. the girl we can tell you is expected to be okay. police are now looking for witnesses to try to help track down the suspects. a live look at oakland police headquarters where police chief howard jordan is expected to address the recent uptick in violence in that city including two recent shootings involving oakland police officers. we'll of course bring you details during our 11:00 a.m. newscast. the family of a walnut creek man shot and killed by police officers last month are now suing the police department.

officers shot 22-year-old anthony banta on december 27th after they say he charged at them with a knife. police say banta had gotten into a fight with his roommate before they arrived. banta's family says the fight was over before police arrived and one officer fired his gun in a panic after another officer tripped and fell behind him. banta's family is suing four members of the police department for $15 million in damages. vallejo police are now involved in a hazing investigation at a catholic high school that led to five students being expelled. police say several freshmen football players at st. patrick-st. vincent high school reported they had been the victims of sexual hazing rituals at the hands of varsity players. the alleged assaults happened in the locker room during the football season. the coach has since been fired and five of the alleged offenders have been expelled. prosecutors dropped a serious charge against a private contractor accused of being

bridge over highway 17 in los gatos with messages like happy 30th anniversary, happy birthday, that sort of thing. the owners of the bridge sent someone out to check it out. they realized that the fence is flimsy. with added weight of these locks, there's a chance this structural integrity could be compromised especially if there was a wind storm. the fear being that a wind storm would knock this down on the cars below. so caltrans said something had continue to be done in the city of los gatos in charge of the maintenance on the upper deck saying they have to come down and come this friday, february 1st, they'll be snipping them off. >> it's outrageous. it's not the city. it's caltrans. i think it's sad. how are they hurting anything here with locks? >> i think it's a shame. it's a nice gesture to put a lock up. romantic gesture, i guess.
